Terms of Service

Please read these terms carefully before booking an expedition with Trembling Trebles. By making a booking, you agree to be bound by these terms and conditions.

1. Booking & Payment

All bookings are subject to availability and confirmation by Trembling Trebles.

  • A non-refundable deposit of 50% of the total package price is required to secure your booking.
  • The remaining balance must be paid in full no later than 30 days before the scheduled departure date.
  • Failure to pay the balance by the due date may result in automatic cancellation of your booking, with the deposit forfeited.
  • We accept payment via bank transfer, credit card, or other methods specified at the time of booking.
  • All prices are quoted in South African Rand (ZAR) unless otherwise stated, and are subject to change until a booking is confirmed.

2. Cancellation Policy

Cancellations must be made in writing via email. The following refund schedule applies based on the date of cancellation relative to the departure date:

  • 60+ days before departure Full refund minus deposit
  • 30–59 days before departure 50% refund of balance paid
  • 15–29 days before departure 25% refund of balance paid
  • Less than 15 days No refund

We strongly recommend purchasing comprehensive travel insurance to cover cancellation costs.

3. Liability Limitations

Trembling Trebles operates adventure-based activities including deep-sea fishing, safari game drives, helicopter transfers, and other outdoor excursions. Participation in these activities carries inherent risks.

  • All participants acknowledge and accept the risks associated with adventure activities by signing a liability waiver prior to the expedition.
  • Trembling Trebles shall not be held liable for any injury, loss, damage, or death arising from participation in any activity, except where caused by our proven negligence.
  • We are not liable for any loss or damage to personal property, including but not limited to fishing equipment, luggage, cameras, or electronic devices.
  • Our liability for any claim shall not exceed the total amount paid for the booking in question.

4. Travel Insurance

All guests are required to hold comprehensive travel insurance that covers the following as a minimum:

  • Medical expenses and emergency evacuation
  • Trip cancellation and interruption
  • Personal liability
  • Adventure and water-based activities
  • Loss or damage of personal belongings

Proof of insurance may be requested before departure. Trembling Trebles reserves the right to refuse participation to any guest without adequate insurance coverage.

5. Weather & Conditions

Our expeditions are subject to weather and sea conditions that are beyond our control.

  • We reserve the right to modify, reschedule, or cancel any activity due to adverse weather, sea conditions, or safety concerns.
  • Where possible, alternative activities or rescheduled dates will be offered at no additional cost.
  • No refunds will be issued for activities cancelled due to weather unless the entire trip is cancelled and cannot be rescheduled.
  • Fishing success is not guaranteed. Catch rates depend on natural conditions and are not within our control.

6. Group Sizes

To ensure a premium experience, group sizes are strictly limited.

  • Maximum group sizes vary by package and will be confirmed at the time of booking.
  • Private charters and exclusive-use options are available at additional cost.
  • We reserve the right to combine smaller groups on shared excursions unless a private charter has been booked.
  • Minimum group numbers may apply for certain expeditions. If the minimum is not met, we will offer alternative dates or a full refund.

7. Photography Rights

During your expedition, photographs and video footage may be taken by our team or professional photographers.

  • By participating in an expedition, you grant Trembling Trebles permission to use any photographs or video footage captured during the trip for marketing, social media, and promotional purposes.
  • If you do not wish to be photographed, please inform us in writing prior to the expedition.
  • Personal photographs taken by guests may be shared on social media with appropriate credit to Trembling Trebles.

8. Governing Law

These terms and conditions are governed by and construed in accordance with the laws of the Republic of South Africa.

Any disputes arising from these terms or from any booking made with Trembling Trebles shall be subject to the exclusive jurisdiction of the courts of the Western Cape, South Africa.

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
